DigitalBooking is provided by TeoPix Creative. In these Terms, "DigitalBooking", "we", "our", and "us" refer to that entity.
2. Acceptance of These Terms
By accessing, registering for, downloading, or using DigitalBooking, you agree to these Terms of Service and our Privacy Policy. If you use DigitalBooking on behalf of a company, venue, or other organisation, you confirm that you are authorised to bind that organisation to these Terms.
3. Eligibility and Business Use
You may use DigitalBooking only if you can form a binding contract under applicable law and your use of the service is not prohibited by law. If DigitalBooking is offered for business use, you are responsible for ensuring that your staff, team members, and invited users comply with these Terms.
4. The Service
DigitalBooking provides tools that may include hosted booking pages, reservation request management, customer notifications, team access controls, operational settings, calendar-related workflows, dashboards, and subscription management features. Features may change over time, and some features may only be available on certain plans, devices, or in certain territories.
5. Accounts and Security
- You must provide accurate, current, and complete information when creating or maintaining an account.
- You are responsible for safeguarding your password, login credentials, devices, and access to your account.
- You are responsible for all activity that occurs under your account, including staff access, settings, reservations, customer messages, and administrative actions.
- You must notify us promptly if you believe your account or credentials have been compromised.
6. Subscriptions, Billing, and Renewals
DigitalBooking may be offered on a paid subscription basis. Pricing, billing intervals, trial periods, included features, and upgrade options are presented at or before purchase. Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle until cancelled.
You authorise us and our payment providers to charge the applicable subscription fees, taxes, and other agreed amounts using your selected payment method. If payment cannot be completed, we may suspend or limit access until the account is brought up to date.
If you subscribed through the Apple App Store or Google Play, your billing, cancellation, refund, and renewal settings may also be governed by the applicable store's rules and purchase flow.
7. Cancellations and Refunds
You may cancel future renewals at any time through your account settings, the relevant app store subscription settings, or by contacting support where applicable. Unless required by law, fees already paid are non-refundable, and partial billing periods are not refunded.
If you offer bookings to your customers using DigitalBooking, you remain solely responsible for your own cancellation, no-show, rescheduling, and refund policies for those bookings.
8. Customer Data and Reservation Content
You retain responsibility for the information you or your customers submit to DigitalBooking, including reservation details, customer communications, public booking page content, and internal business settings. You represent that you have the necessary rights, notices, and permissions to collect and use that information and to instruct us to process it on your behalf.
We may process customer data as described in our Privacy Policy and as needed to provide the service.
9. Acceptable Use
You must not, and must not allow others to:
- Use DigitalBooking for unlawful, fraudulent, deceptive, harmful, threatening, abusive, or discriminatory activity.
- Upload or distribute content that infringes another person's intellectual property, privacy, publicity, or other rights.
- Send spam, unauthorised marketing, or unwanted communications through the service.
- Attempt to gain unauthorised access to DigitalBooking, its systems, user accounts, or related networks.
- Interfere with, overload, disrupt, scrape, reverse engineer, or misuse the service except where such restriction is prohibited by law.
- Use DigitalBooking in a way that could create legal liability for us or other users.
10. Mobile Apps and App Stores
If you download the DigitalBooking mobile app from the Apple App Store or Google Play, you acknowledge that these Terms are between you and DigitalBooking, not with Apple or Google, except where store rules require otherwise. Your use of the app must also comply with the applicable store terms and device usage rules.
11. Third-Party Services
DigitalBooking may integrate with or rely on third-party products and services such as payment providers, cloud hosting, analytics, communications providers, authentication systems, and app stores. We are not responsible for third-party services, and their use may be subject to separate terms and privacy policies.
12. Intellectual Property
DigitalBooking and its related software, content, branding, design, trademarks, and documentation are owned by us or our licensors and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use DigitalBooking for your internal business purposes.
You may not copy, modify, distribute, sell, sublicense, or create derivative works from DigitalBooking except as expressly permitted by law or with our prior written consent.
13. Feedback
If you send us suggestions, ideas, or feedback about DigitalBooking, you agree that we may use that feedback without restriction or compensation to you.
14. Availability and Changes
We aim to keep DigitalBooking available and reliable, but we do not guarantee uninterrupted, secure, error-free, or always-available service. We may add, remove, suspend, or modify features, plans, or technical requirements at any time.
15. Suspension and Termination
You may stop using DigitalBooking at any time. We may suspend, restrict, or terminate your access immediately if we believe you have breached these Terms, created risk, failed to pay amounts due, violated applicable law, or used the service in a way that could harm us, other users, or the platform.
On termination, your right to use DigitalBooking ends immediately, but sections that by their nature should survive termination will remain in effect, including payment obligations, liability limitations, dispute provisions, and intellectual property terms.
16. Disclaimers
To the fullest extent permitted by law, DigitalBooking is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.
17. Limitation of Liability
To the fullest extent permitted by law, DigitalBooking and its officers, directors, employees, affiliates, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings arising from or related to your use of the service.
To the fullest extent permitted by law, our total aggregate liability arising from or related to DigitalBooking will not exceed the amount you paid to us for the service during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
18. Indemnity
You agree to defend, indemnify, and hold harmless DigitalBooking and its affiliates, personnel, and service providers from claims, liabilities, damages, losses, and expenses arising out of or related to your content, your bookings, your customers, your misuse of the service, or your breach of these Terms, except to the extent caused by our own breach or misconduct where indemnity cannot be imposed by law.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales, excluding conflict of laws rules. You and DigitalBooking agree that the courts of England and Wales will have exclusive jurisdiction except where applicable consumer law requires otherwise.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify you by posting the updated version on our website, through the app, by email, or by other reasonable means. Your continued use of DigitalBooking after the updated Terms become effective means you accept the revised Terms.
